Terms Of Service

1. Acceptance of Terms

By accessing and using the services of Hamptons Property Management ("we," "us," or "our"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Provided

Hamptons Property Management provides comprehensive property management services including but not limited to:

  • Property maintenance and repairs
  • Guest management and concierge services
  • Financial reporting and management
  • Vendor coordination and oversight
  • Emergency response services

3. Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete property information
  • Maintain adequate insurance coverage on your property
  • Pay all fees and charges on time as specified in your service agreement
  • Grant necessary access to your property for service delivery
  • Respond promptly to communications regarding your property

4. Fees and Payment

Service fees will be specified in your individual service agreement. Payment terms include:

  • Monthly management fees as outlined in your contract
  • Additional charges for special services or emergency repairs
  • Reimbursement for approved property expenses
  • Late payment fees may apply to overdue balances

5. Service Standards

We are committed to providing high-quality property management services. However, we cannot guarantee specific outcomes and are not liable for:

  • Property damage from natural disasters or unforeseen events
  • Actions of third-party vendors or contractors
  • Guest behavior or actions beyond our reasonable control
  • Market conditions affecting property value or rental income

6. Limitation of Liability

To the fullest extent permitted by law, Hamptons Property Management shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

7. Termination

Either party may terminate the service agreement with written notice as specified in the contract. Upon termination:

  • All outstanding fees must be paid
  • Property access and keys must be returned
  • Final accounting will be provided within 30 days
  • Client data will be handled according to our Privacy Policy

8. Confidentiality

We maintain strict confidentiality regarding client information and property details. This obligation continues even after the termination of services, except where disclosure is required by law.

9. Dispute Resolution

Any disputes arising from these Terms of Service or our services shall be resolved through:

  • Initial good-faith negotiation between the parties
  • Mediation if negotiation is unsuccessful
  • Binding arbitration in accordance with New York law

10. Governing Law

These Terms of Service are governed by the laws of the State of New York, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated to active clients. Continued use of our services constitutes acceptance of modified terms.
